Terms of Service
These Terms of Service ("Terms") govern your access to and use of secretshoppers.online (the "Site") and your participation, if any, in our mystery shopping program (the "Program"), operated by Secret Shoppers LLC d/b/a Secret Shoppers Online ("we," "us," or "our"). By using the Site or submitting an application, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and a legal U.S. resident to use this Site or participate in the Program. By using the Site, you represent and warrant that you meet these requirements.
2. No employment relationship
Participation in the Program is as an independent contractor, not as an employee. You are solely responsible for your own taxes and any expenses incurred in connection with your participation. We do not provide employee benefits of any kind.
3. Application and acceptance
Submitting an application does not guarantee acceptance into the Program. We accept applicants at our sole discretion. Acceptance does not guarantee any minimum number of assignments or earnings.
4. Shopper obligations
If accepted, you agree to: complete assignments honestly and based on personal observation; maintain confidentiality of client identities and assignment details; submit reports on time and accurately; not disclose your shopper status during any assignment; and comply with all applicable laws.
5. Prohibited conduct
You may not: submit false or fabricated reports; share assignment details publicly or with third parties; solicit other shoppers to breach their obligations; use the Program for any fraudulent purpose; or violate any applicable laws in connection with your participation.
6. Compensation
Compensation per assignment is set forth in the applicable assignment brief. We make no guarantee of minimum earnings. We will not pay for assignments that are incomplete, late, or that contain fabricated information.
7. Intellectual property
All content on this Site is owned by or licensed to us. You may not copy, reproduce, or distribute Site content without our written permission.
8. Disclaimer of warranties
The Site and Program are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Site will be error-free, uninterrupted, or that any particular volume of assignments will be available.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising out of your use of the Site or participation in the Program.
10. Indemnification
You agree to indemnify and hold harmless Secret Shoppers LLC and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, participation in the Program, or violation of these Terms.
11. Termination
We may suspend or terminate your participation in the Program at any time and for any reason, including violation of these Terms. You may withdraw from the Program at any time by emailing support@secretshoppers.online.
12. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Nassau County, New York.
13. Changes to these Terms
We may update these Terms from time to time. Continued use of the Site or Program after changes constitutes acceptance.
